Welcome to Craving Smasher! These Terms and Conditions ("Terms") govern your use of the Craving Smasher mobile application ("App") operated by Craving Smasher ("we," "our," or "us").

1. Description of Service

Craving Smasher is a wellness and habit-awareness application designed to help users manage cravings through:

• Short distraction games
• Mood and craving tracking
• Progress visualization and streak tracking
• Optional breathing exercises

Certain in-app responses, such as mood or craving selections, are required to use core features of the App.

The App is intended for general wellness purposes only and is not a medical device, therapeutic tool, or substitute for professional treatment.

2. Eligibility

You must be at least 13 years old to use this App.

If you are under 18, you confirm that you have parental or guardian consent to use the App.

3. Account Registration

Guest Mode

You may use the App without creating an account for a limited number of sessions (currently up to two uses). After this limit, account creation is required to continue using the App.

Guest data is stored locally on your device and may be lost if you clear app data or uninstall the App.

Registered Accounts

To access full features, you must create an account using:

• Email and password, OR
• Sign in with Google, OR
• Sign in with Apple

You are responsible for:

• Providing accurate information
• Maintaining the security of your login credentials
• All activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt App functionality
• Reverse engineer, decompile, or extract source code
• Use bots, scrapers, or automated access
• Impersonate another person or entity
• Upload malware or malicious code

5. Health and Wellness Disclaimer

Craving Smasher:

• Is not a medical or therapeutic application
• Does not provide medical advice, diagnosis, or treatment
• Is not a substitute for professional healthcare or addiction treatment
• Is not an emergency intervention tool

If you are experiencing a medical emergency, mental health crisis, or severe addiction, seek professional help immediately.

We make no guarantees regarding outcomes. Individual results vary.

6. Intellectual Property

All content in the App—including text, graphics, logos, icons, images, audio, games, and software—is owned by Craving Smasher or its licensors and protected by intellectual property laws.

You may not copy, distribute, modify, or create derivative works without written permission.

7. User-Generated Data

Data you enter (such as mood selections, craving logs, and progress data) remains associated with your account.

Progress tracking and streaks are core features and are automatically updated based on App usage.

You may request deletion of your data at any time by:

• Using the Delete Account feature in Settings, or
• Emailing support@cravingsmasher.com

8. Advertisements

The App may display advertisements in the free version. Ads are provided by third-party networks and subject to their own terms and privacy policies.

9. Premium Features and In-App Purchases

We may offer premium subscriptions or one-time purchases, including ad-free access.

• Payments are processed through Apple App Store or Google Play
• Billing, cancellation, and refunds are governed by the respective app store
• We may change pricing or features at any time

9.1 App Store Acknowledgement (Apple Requirement)

You acknowledge that these Terms are between you and Craving Smasher, not Apple Inc. Apple is not responsible for the App, its content, maintenance, or support. Any claims relating to the App must be directed to Craving Smasher.

10. Service Availability

We do not guarantee uninterrupted access. The App may be unavailable due to maintenance, updates, technical issues, or connectivity problems.

We may modify or discontinue the App at any time.

11. Termination

We may suspend or terminate access if you violate these Terms or misuse the App.

You may stop using the App at any time. To delete your account, use the in-app option or contact support.

12. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "AS IS" and "AS AVAILABLE"
• We disclaim all warranties, express or implied
• We are not liable for indirect or consequential damages
• Our total liability will not exceed the amount you paid us in the last 12 months (if any)

You use the App at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Craving Smasher from any claims arising from:

• Your use of the App
• Violation of these Terms
• Violation of third-party rights

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the State in which Craving Smasher is registered, without regard to conflict-of-law principles.

16. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Craving Smasher.
